Terms of Service

Preamble
These Terms of Service are subject to change at anytime. By signing up to the game or logging in to your account, you are agreeing to these terms and any updates there in. While we attempt to give notice to updates, there may be times in which we do not. This does not negate your responsibility to the current Terms of Service.

1. Accounts

1.1 Age
This game is not intended for persons under the age of 13 years old. By signing up for an account, you agree to enter your correct date of birth as verification. Misrepresenting your age will result in the removal of your account.

1.2 Accurate and Current Information
When registering for Secfenia, you agree to (a) provide true, accurate, current and complete information about yourself as prompted by the registration form and (b) maintain and promptly update it to keep it true, accurate, current, and complete. Failure to do so or the suspecion of such results in reasonable grounds for your account to be suspended or any/all current or future use of the Service to be terminated.

1.3 Password and Security
You are responsible for maintaining the confidentiality of the password associated with your account. You are fully responsible for all activities that occur under your account. You agree to (a) immediately notify Secfenia of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.
Secfenia can not and will not be liable for any loss or damage arising from your failure to comply with this Section.

1.4 Multiple Accounts (Multi's)
You are only permitted one Secfenia account unless you are grandfathered in under the Multi-Account Household policy. If you are found with more than one account on any given network, all accounts may be removed. Those who have multiple players in the same household must follow the Multi-Account Household policy.

1.5 Account Sharing
Accounts can only be accessed by the person who initially signed up. They may not be transferred to a new owner or sold to any third party. Accounts being shared or transferred may be terminated.

2. Member Conduct

2.1 Content
To the extent that portions of this site provides users an opportunity to post and/or exchange information, ideas, and opinions in chat rooms, forums, mails, etc Please be advised that postings do not necessarily reflect the views of the staff and owner of Secfenia. Although we periodically monitor exchanged and posted information, in no event does Secfenia assume or have any responsibility or liability for any postings or for any claims, damages or losses resulting from their use and/or appearance on or in conjunction with this site or elsewhere. Users remain solely responsible for the content of their messages and postings. However, Secfenia reserves the right to edit, delete, or refuse to post any Posting that violates these Terms and Conditions, as well as revoke the privileges of any user who does not comply with these Terms and Conditions.

2.2 Bug Abuse
Any person found to abuse a bug or glitch within the site may be suspended or have their account removed. Advantages gained from the bug may be removed at the discretion of the administrative team. If you come across a bug, it is your responsibility to report it via the Bug system or by sending a mail to Zachrin.

2.3 Suspicious Activity
If account activity leads to suspicion of violation of Terms of Services through use of unauthorized software, timers, add-ons, or any other manner inconsistent with fair game play, that account is subject to suspension until investigation produces a conclusion.

2.4 Safety and Inappropriate Conduct

2.4.1 Threats/Harassment
Any person may be considered a threat if they are involved consistently in acts that will make the game less enjoyable for other members. This includes harassing players, slander, abuse, exposing private or inappropriate information. Depending on how threatening the person is considered to be, the consequence can vary from loss of communication to account removal. All players that are taking part of contributed to the situation will be investigated.

2.4.2 Safety
Any player who poses a viable threat, as determined by Secfenia, to the physical safety of another member will be considered a serious threat and may have their account removed and additional sanctions as necessary. This particularly applies to anyone who misrepresents their age for the purposes of inappropriate conduct with a minor or a minor who does the same and endangers other members in this way.

2.4.3 Trolling
A player who trolls members may be banned for an indefinite period of time and/or have their account removed. Trolling is the act of consistently disrupting areas of the game (including, but not limited to, profiles, blogs, and public chat and forums) with the specific purpose of reducing others' enjoyment of the game. This includes discouragement from financially supporting the game.

2.4.4 Abuse
Being abusive to other players and staff is strictly prohibited. You may be banned from any or part of our service if you verbally abuse staff or other players.

2.4.5 Impersonation
You are not permitted to impersonate any person or entity, including, but not limit to, an official of Secfenia or false state or otherwise misrepresent your affiliation with a person or entity

2.4.6 Solicitation
You are not permitted to solicitate or conduct transaction of real life funds via any Secfenia medium. Attempting to acquire real life currency by request, or for the sale of in-game or actual items is prohibited and may result in bans and/or account deletion/restriction. You are not permitted to sell any in game currency or items for real cash and/or cash purchases made for you or for others.

2.4.7 Personal Information
Attempting to obtain personal information (such as email, phone number, address, full name, etc.) from a minor (under age 18) that could allow "offline contact" is strictly forbidden. Any users found attempting to obtain (or give) personal information, or account information (such as signup email and password), may be banned indefinitely from the site.

2.4.8 Hacking, Forged Headers, and Manipulation of Identifies
Any player found to be forging headers, manipulating identifiers in order to disguise the original of any Content transmitted through the Service, gain advantage for themselves, or do behavior that Secfenia feels interrupts fair game play, disrupts the Service, and/or makes available software that are designed to interrupt, destroy or limit the functionality of any computer may have their account removed and possible further sanctions applied.

2.4.9 Illegal Activities
Players are prohibited from promoting or providing instructional information about illegal activities, promoting physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons or incendiary devices

2.4.10 Commercial Acitivites
Players are prohibited from engaging in commercial activities within Secfenia or on behalf of Secfenia without prior approval. Attempted collection of player's information for commercial purposes is grounds for immediate termination of accounts.

2.5 Accusations
Every player has the right to accuse another play of cheating or violating our terms of service, policies, and/or Code of Conduct, but must do so via IG or Forum mail to a member of the Administrative Team.

3. Payments

3.1 Free to play
All accounts are free and the game is free to play. However, there are optional perks that may provide you in-game extras. All potions are one-time payments only. Potions may be refunded within 30 days if it has not been used.

3.2 Charge backs
Players agree if any payment transaction tied to their account is charged back or refunded, your account will lose all of what you gained from it. In the event that there is a discrepancy, Secfenia's administrative team has the right to decide what should be removed.

3.3 Ads
Ads are provided to help support the site. Players may use an Ad Free potion to remove them. We are not held responsible for the content on the ads. While we may monitor the content, some ads may not meet the "safe for work" qualification. Please contact us if that is the case and we will fix the issue.

4. Rights and Governance

4.1 Connectivity
We do our best to keep the game running and available 24/7. However, there is no guarantee that there will not be down time. We will attempt to give notification when possible, but at times there may be unplanned down times.

4.2 Staff
Our owner has final say on everything. Our Staff work with our owner either directly or indirectly to create a fun and safe environment for everyone. Being abusive to any of our staff is strictly prohibited.

4.3 Accounts
All accounts remain the property of Secfenia and members are given rights to access them. We may hold accounts after players are terminated from using them or delete them to ensure compliance with legal investigations or internal investigations as well as to hold them for possible undeletion.

4.4 Intellectual Rights

4.4.1 Images by Carys Lovell
Some images were created by Carys Lovell for the exclusive use on "The World of Secfenia" which may only be used on this site. The images may not be sold, redistributed or used for any other projects. Any edits by any party that uses this site will not nullify this requirement. Only the author may display these images off site and generate income from these images.

4.4.2 Pandora Project Code
Any individual who attempts to reverse engineer, hack, gain unauthorized entry into or undermine the system integrity of Secfenia (including attempting to access any internal part of the game from an offsite location) will be dealt with to the fullest extent.

4.5 Content Submitted
By making any User Content available through the Site, you hereby grant us a non-exclusive, worldwide, royalty-free license and permission (a) to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform and distribute your User Content in connection with operating and providing the Site and Content to you and to other users of the Site, and (b) to the extent that you share your own story as part of User Content, to use your name, likeness and biographical material, solely as necessary to exercise the foregoing license rights.

4.6 Violations of Terms of Service, Policies, and/or Code of Conduct
If any user is reported to be in violation with the letter or spirit of these terms, Secfenia retains the right to terminate or suspend such account at any time without warning. In most cases, we will send notification of suspension. Please familiarize yourself with all game rules before playing. Failure to be familiar with the game rules is not an excuse for breaking them and will not be accepted as a defence of your account.

4.7 Limitation of Service
The owner may ban or limit your use of this service without having to give warning if the owner sees fit. Your game play may be limited if you are felt to have violated the spirit of the terms of service, policies, and/or Code of Conduct.

4.8 Governed by
These Terms of Service will be governed by and construed in accordance with the laws of Citrus County in the State of Florida, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the TOS to be unenforceable, the remainder of the Terms of Service will continue in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
